When does the fault message appear, is it whilst driving, or after you have selected Park ? Interesting fault, there can only be so many error messages in the BC system, have you read any OBD codes ?

It only does it sometimes and it is always when I start the car. I'm not sure how to look for the code sorry.
I have also stopped on hills and the park always holds the car without the handbrake engaged so I'm not sure what the message is meaning, saying park may not be available

You will need to get the fault log read either by BMW or a specialist.  That will then give you a clue as to what might be wrong.

It could be that the 'Park' pawl (transmission locking device) is not working properly and momentarily hesitating to move which could be enough to flag a short lived warning message.

It would help if you said which model/year of E70 you have as there are multiple gearbox units that were used over the life of the model (6 or 8 speed).

Hi.  I have the same problem on mine.  Not sure if you got to the bottom of yours?  Having the faultcodes looked at in the next couple of weeks when in for MOT.

I forgot to post on here.  I had the fault codes check at the local Indi.  Nothing on there at all.  The gear selector has since made a whiring noise when selecting drive or reverse at times so sounds like a gear selector issue.  Noticed a new thread on here a couple of days ago so added to that.

Just to close this off. Was actually the battery.  Started having other odd things such as the radio being on mute at startup.  Replaced battery and now works fine.
